This Privacy Notice explains how we collect, use, store and share personal information when you:

  • visit the McCarthy Talent website;
  • contact or communicate with us;
  • approach us seeking representation;
  • are represented by McCarthy Talent;
  • interact with us professionally as a casting director, production company, hirer, supplier or other industry contact; or
  • otherwise provide personal information to us.

If you become a client of McCarthy Talent, we use your personal information in order to represent you and to fulfil our obligations under our representation agreement.

  1. What personal information we collect

The information we collect depends upon your relationship with McCarthy Talent.

Representation enquiries

If you contact us seeking representation, we may collect information including:

  • your name;
  • email address and telephone number;
  • CV and professional credits;
  • headshots;
  • showreels and other professional media;
  • Spotlight or other professional profile information;
  • training and professional experience;
  • social media or professional website details; and
  • any other information you choose to provide as part of your enquiry.

Represented clients

If you are represented by McCarthy Talent, we may also collect and use information necessary to provide our representation services, including:

  • contact details;
  • date of birth;
  • professional and casting information;
  • headshots, CVs, showreels and other promotional material;
  • availability and booking information;
  • contracts and engagement details;
  • right-to-work information where required;
  • bank and payment details;
  • invoices and payment records; and
  • correspondence relating to your representation and professional engagements.

Where we represent a performer under the age of 18, we may also collect information about their parent, guardian or other authorised adult, together with information required for licensing, safeguarding and the administration of professional engagements where appropriate.

In some circumstances, information relevant to professional representation or casting may include information classed as special category data under data protection law. Where this applies, we will only process that information where it is necessary and where we have both a lawful basis and any additional condition required by law.

Industry and business contacts

We may hold professional contact information relating to casting directors, production companies, theatres, advertising agencies, broadcasters, suppliers and other industry professionals where this is reasonably necessary to operate

Website visitors

The McCarthy Talent website does not currently contain a contact form, user accounts, online payments or analytics tracking.

Our website hosting provider may process limited technical information necessary to deliver and secure the website, such as IP address, browser or device information and server logs.

  • communicate with prospective and represented clients;
  • provide professional talent representation;
  • identify suitable professional opportunities for represented clients;
  • submit clients for casting and professional opportunities;
  • liaise with casting directors, production companies, theatres, advertising agencies, broadcasters and other hirers;
  • negotiate fees, contracts and engagement terms;
  • administer bookings, contracts, invoices and payments;
  • maintain appropriate business, contractual and financial records;
  • manage our professional relationships with industry contacts;
  • operate, maintain and secure our website and business systems;
  • comply with legal, regulatory, accounting and tax obligations; and
  • establish, exercise or defend legal rights where necessary.
  1. Our lawful bases for using personal information

We only use personal information where we have a lawful basis to do so.

Depending on the circumstances, we may rely on:

Contract – where processing is necessary to take steps at your request before entering into a representation agreement, or to perform our obligations under an existing representation agreement.

Legitimate interests – where it is reasonably necessary for the operation of McCarthy Talent, including responding to professional enquiries, managing industry relationships, administering the agency and maintaining the security of our website and systems, provided those interests are not overridden by your rights and interests.

Legal obligation – where we need to process information in order to comply with a legal requirement.

Consent – where consent is the appropriate basis for a particular use of your information. Where we rely on consent, you may withdraw it at any time.

Different lawful bases may apply to different uses of your personal information.

  1. Representation and sharing professional information

Where you are represented by McCarthy Talent, we will use and share appropriate professional information as necessary to seek and administer professional opportunities on your behalf.

This may include your name, headshots, CV, showreel, Spotlight profile, professional credits and other relevant casting information.

This information may be shared with casting directors, production companies, theatres, broadcasters, advertising agencies and other legitimate potential hirers or industry professionals.

Relevant professional information may also appear on the McCarthy Talent website as part of our roster.

Actor profiles on our website may link directly to the actor's professional Spotlight profile.

  1. Who we may share information with

Where reasonably necessary, we may share personal information with:

  • casting directors and casting offices;
  • production companies;
  • theatres, broadcasters and advertising agencies;
  • other potential hirers of represented performers;
  • Spotlight and other professional casting platforms;
  • Tagmin and other technology used to manage the agency;
  • website hosting, email and IT service providers;
  • banks and payment providers;
  • our accountant, legal advisers and other professional advisers;
  • suppliers or contractors providing services to McCarthy Talent; and
  • regulators, courts, law-enforcement bodies or other authorities where disclosure is required or permitted by law.

We only share information where there is a legitimate reason to do so and limit the information shared to what is reasonably necessary for the relevant purpose.

  1. International transfers

The entertainment industry operates internationally and some professional opportunities, hirers or technology providers may be located outside the United Kingdom.

As a result, personal information may occasionally be transferred to or accessed from another country.

Where UK data protection law requires safeguards for an international transfer, we will take appropriate steps to ensure that the transfer is lawful.

  1. How long we keep personal information

We keep personal information only for as long as we reasonably need it for the purpose for which it was collected and to meet any legal, accounting, contractual or regulatory obligations.

Representation enquiries

Where an individual approaches McCarthy Talent for representation but does not subsequently become a client, we will normally retain the information submitted for up to 12 months after the enquiry has concluded, unless there is a particular reason to retain it for longer or the individual asks us to delete it sooner and we have no lawful reason to continue holding it.

Represented clients

Information relating to represented clients will generally be retained for the duration of the representation relationship and afterwards for as long as reasonably necessary to:

 

  • administer any outstanding bookings, fees or residual payments;
  • fulfil accounting, tax and legal obligations;
  • maintain appropriate business records;
  • resolve disputes; or
  • establish, exercise or defend legal claims.

General correspondence

General enquiries and professional correspondence will be retained only for as long as reasonably necessary for the purpose of the communication and any appropriate follow-up.

We periodically review the personal information we hold and delete or anonymise information that is no longer required.

We take appropriate technical and organisational measures to protect personal information against accidental loss, unauthorised access, misuse, alteration or disclosure.

We use reputable business and technology service providers and take reasonable steps to ensure access to personal information is restricted to those who require it for legitimate business purposes.

While we take appropriate precautions, no transmission of information over the internet can be guaranteed to be completely secure.

McCarthy Talent does not currently use solely automated decision-making or profiling which produces legal or similarly significant effects on individuals.
